Eugene Equipment Auction LLC Terms & Conditions

 REGISTRATION & BID NUMBER ACCEPTANCE: By registering and accepting a bid number online, the bidder acknowledges they have read, understand and agrees to be bound by the terms and conditions of Auction posted online in this document.  You are responsible and liable for all bids you place live or online!

It is required to register a credit card to bid. We do not accept debit cards for payment or to register with.

ONLINE BIDDERS:  When you register for a bidder number you will be required to provide your credit card number.  Your credit card number will be retained and charged for your purchase if alternate payment arrangements are not made by 24hrs after the auction closes.  By clicking the accept button online, you enter into a binding legal agreement with Eugene Equipment  Auction LLC.  Eugene Equipment Auction is providing internet online bidding as a service to the bidder. Bidder acknowledges and understands that internet and/or phone service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Eugene Equipment Auction or anyone else if their Internet service fails to work correctly before or during the auction. The auction will have a staggered and soft close. Soft close is set at 1 minute.  REGISTER IN ADVANCE to make sure you are able to complete the process in time to bid on the items you want to buy. Call 541 998 3354 for assistance with registering. We WILL NOT be able to walk you through the registration process day of the auction.  MAKE SURE YOU HAVE ADEQUATE INTERNET OR PHONE SERVICE.  This will make a difference in your ability to bid successfully during the closing of the auction.  If you have slow internet or phone service please utilize the max bid feature.  The computer program will bid for you up to your max bid.  It will NOT jump you to your max bid.  The program will bid in the preset increments for you against other internet bidders.

BUYER'S PREMIUM:  There is a 10% buyers premium on all items.

There is a 3% processing fee added to any credit card payments. We do not accept debit cards.

Lots will have a "STAGGERED" and "SOFT CLOSE". You will be notified by email invoice if you are the winning bidder. Email invoices will be sent out after the Auction closes.

What is a "STAGGERED CLOSE"? The lots do not close all at the same time. Lots will have a staggered closing using a mixed sequence. Follow the clock to the right of each lot to know the exact closing time of a particular lot.

What is a "SOFT CLOSE"?? If a bid is submitted and confirmed during the last 1 minute before closing, then the time will be extended on that lot by 1 minute. This will continue until a full minute passes without a new bid on that lot.

 GENERAL TERMS OF AUCTION: It is the bidder's responsibility to preview and inspect the items prior to bidding/buying and determine the condition of the item they are bidding on. All articles of merchandise are offered "As Is, Where Is" by lot, individually or in groups as described in the online catalog. Multiple photos have been posted of each lot, in order to show the most accurate condition. Any chips, cracks, or blemishes have been photographed and posted to the best of our knowledge. No claim will be considered for allowance adjustment or rescission of any sale based upon the failure of the property to correspond to any particular standards or expectations of the buyer. It is important that the buyer avail themselves of the inspection periods. All items sold "AS IS" meaning the bidder is responsible for due diligence in inspecting all items. Eugene Equipment Auction will pass on any information, good or bad, that the seller gives to us in describing the items. However, it is up to the buyer to determine the condition of the item they are bidding on. All sales are final. When a bidder is awarded the winning bid on an item, that bidder instantly becomes the new owner of that item and is completely responsible for that item. EUGENE EQUIPMENT AUCTION RESERVES THE RIGHT TO WITHDRAW OR RE-CATALOG ITEMS IN THIS AUCTION.

PAYMENT: Payment in full is due by 24hrs after the close of the auction, unless arrangements have been made with the office prior to this time.  Purchases cannot be removed from the auction site until paid for in full. There is a 3% processing fee added to all credit card payments. We do not accept debit cards.

REMOVAL OF ITEMS/SHIPPING & HOLD HARMLESS: The buyer is solely responsible for removal and shipping of their own purchases. 

Removal of all items shall be the sole responsibility of the purchaser. Loading assistance is provided as a courtesy; however, purchaser assumes all risk and responsibility for loading and removal of purchases. Auctioneer reserves the right to require proof of adequate insurance coverage from any purchaser items requiring dismantling, rigging or hot cutting. Purchaser agrees to indemnify and save harmless both, consignor and Auctioneer, its officers, directors, employees, agents, and attorneys against any damage caused by the acts of purchaser. All items must be removed from the auction facility within 7 days after the auction date. If for any reason purchaser fails to remove any purchase within the time specified, the purchase shall be deemed abandoned, and Auctioneer at its sole discretion may resell the items. Purchaser shall be liable for any rent incurred or damages suffered by Auctioneer because of purchaser's failure to remove any item. Failure to remove items will result in a rental / storage fee of not less than $25 per item per day.

SHIPPING is available for SMALL items at BUYER'S expense.  Shipping charges will include all package materials and handling fees.

HOLD HARMLESS: The purchaser hereby agrees to indemnify and hold harmless Eugene Equipment Auction and the seller, against any and all liability, loss, costs, damages and other expenses arising from loading out of items by Eugene Equipment Auction on the purchaser's behalf. All lots must be removed within the times noted in these terms and conditions. Any lots not picked up or have had other arrangements made by 7 days after the auction forfeit ownership of the items to the Eugene Equipment Auction and will be re-sold with proceeds going to the Eugene Equipment Auction.

Eugene Equipment Auction LLC does not provide for a "cooling off" or other cancellation period for vehicles. Therefore, you cannot later cancel a contract simply because you change your mind, decide the vehicle costs too much, or wish you had acquired another vehicle.

A document processing fee will be charged by the auction company for every DMV purchase, whether sold independently or grouped into one lot and regardless of the purchaser's intended use of the purchase. Funds must be certifiable prior to the processing or release of DMV documents. Title documents will be prepared to be effective only in the jurisdiction in which the auction is being conducted.

This privacy policy sets out how Eugene Equipment Auction LLC uses and protects any information that you provide to Eugene Equipment Auction. Eugene Equipment Auction is devoted to ensuring that your privacy is protected. Should we ask you to provide certain information by which you can be identified when accessing your account information, you can be assured that such information will only be used in accordance with this privacy statement. Eugene Equipment Auction has a firm policy of protecting the confidentiality and security of information that  we  collect  from  our  buyers and sellers.  We  do  not  share  your  non-public  personal information with unaffiliated third parties. Information is only shared with your consent except for the specific purposes below, in accordance with all applicable laws. Please read this policy carefully. It gives you important information about how we handle your personal information. Eugene Equipment  Auction reserves the right to change this policy at any time. 

 

USE OF INFORMATION

We limit the collection and use of non-public personal information to the minimum we believe is necessary to deliver superior service to you. 

 

WHAT WE COLLECT

We obtain most non-public personal information directly from you or your agents whether in person, by telephone or  electronically. We may obtain the following information: 

 

• First name, last name and job title (including  home address, email address, business address, telephone numbers. Contact information including home telephone numbers and business.)

 

• Accounts with us and transactions and interactions by us, with us or through us.

 

DISCLOSURE

We do not disclose any kind of non-public personal information about our buyers or sellers to anyone, except when we believe it necessary for the conduct of our business, or where disclosure is required by law. Except in those specific, limited situations,  without  your  consent,  we  will  not  make  any  disclosures  of  non-public personal information to anyone.

 

WHAT WE DO WITH THE INFORMATION WE GATHER

We require this information to understand your needs and provide you with better service, following reasons:  and in particular for the •Internal record keeping  •We send emails about our upcoming auctions or alerts on the most current auction. 

• From time to time, we may also use your information to contact you for general account information. We may contact you by email, phone, or mail. 

  •  We may use the information to customize our website to provide better service to you
